Warranty Guidelines

Imperial Tobacco Canada Limited (“we” or “Imperial”) warrants to the owner of the enclosed product (“Product”) will be free from defects in materials and workmanship for a period of one (1) year from the date of purchase (the “Warranty Period”).  If the Product fails to conform to this warranty during the Warranty Period, we will either repair or replace any defective Product, at our sole discretion.  Replacement will be made with a new or refurbished product or component.  If the Product or component is no longer available, replacement may be made with a similar product of equal or greater value, at our sole discretion.  This is your sole and exclusive remedy for breach of this warranty.  Any Product that has either been repaired or replaced under this warranty will have warranty coverage for the longer of l days or the remaining Warranty Period. 

Products returned by purchasers become the property of Imperial.

This warranty only covers faults that occur despite the fact that the Product has been used correctly and the instructions for use have been followed, and faults reported using the correct procedure.

To register the Product and this warranty, visit glo.ca/register.  Products purchased online through www.glo.ca will be delivered to the purchaser pre-registered and will have an extended Warranty Period of one (1) year from the date of purchase.

Warranty exclusions

This warranty does not cover:

• Products marked as “sample” or sold “as is”;
• Products that have been subject to modifications, alterations, tampering, or improper maintenance or repairs;
• Accidental damage (such as scratches or small dents) or damage caused by Acts of God;
• Damage caused by incorrect or non-compliant handling, storage or use (such as electronic overload, improper handling, contact with a liquid);
• Damage due to abuse or misuse of the Product;
• Malfunctions caused by use with incompatible products or connection to such products;
• Damage or malfunctions caused by the purchaser or an unauthorised service provider as a result of an attempt to open the Product or an unauthorised modification to or repair of the Product, the components of the Product or other elements supplied;
• Damage or malfunctions resulting from a failure to comply with the instructions for use.

Also, this warranty does not cover consumable parts (even if packaged or sold with the Product), unless damage is due to defects in materials or workmanship of the Product.

 

 

Reporting of faults

This warranty only applies if the fault is reported correctly and Imperial’s obligations under this warranty are conditioned on the Product owner: (a) reporting the fault by telephone or in writing (contact details below) during the Warranty Period immediately after the fault has been identified, together with a description of the alleged failure; (b) complying with Imperial’s return shipping instructions; and (c) shipping the Product together with proof of purchase (confirmation of date of purchase), at owner’s cost (except where prohibited by applicable law), to Imperial for repair or replacement.  We will have no obligations under this warranty with respect to a returned Product if we determine, in our sole discretion after examination of the returned Product, that the Product is ineligible for coverage under this warranty.  We will bear all costs of return shipping to owner, except with respect to any Product not covered by this warranty, for which owner will bear all shipping costs.

Disclaimer of Warranties

EXCEPT AS STATED ABOVE IN THIS LIMITED WARRANTY, AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IMPERIAL DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES AND CONDITIONS WITH RESPECT TO THE PRODUCT, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR OR GENERAL PURPOSE.  TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IMPERIAL ALSO LIMITS THE DURATION OF ANY IMPLIED WARRANTIES OR CONDITIONS TO THE DURATION OF THIS LIMITED WARRANTY.

Limitation of Damages

IN ADDITION TO THE ABOVE WARRANTY DISCLAIMERS, IN NO EVENT WILL IMPERIAL BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, EXEMPLARY, OR SPECIAL DAMAGES, INCLUDING ANY DAMAGES FOR LOST DATA OR LOST PROFITS, ARISING FROM OR RELATING TO THIS LIMITED WARRANTY OR THE PRODUCT, AND IMPERIAL’S TOTAL CUMULATIVE LIABILITY ARISING FROM OR RELATED TO THIS LIMITED WARRANTY OR THE PRODUCT WILL NOT EXCEED THE AMOUNT ACTUALLY PAID FOR THE PRODUCT BY THE ORIGINAL PURCHASER. 

Severability

If one of the above provisions is found to be invalid, void or unenforceable, in whole or in part, the remaining provisions will be considered as remaining in full force and effect.

Some jurisdictions do not allow limitations on how long an implied warranty lasts or exclusions/limitations on incidental or consequential damages, so the above limitations may not apply to you. 

This warranty gives you specific legal rights, and you may also have other rights which vary from province to province.  The disclaimers, exclusions, and limitations of liability under this warranty will not apply to the extent prohibited by applicable law.
